Terms of Use

These Terms of Use ("Terms") are an agreement between you and Last Can ("Last Can", "we", "us") governing your use of the Last Can mobile app and the getlastcan.com website (together, the "Service"). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Last Can

You must be at least 18 years old, or the legal age to purchase tobacco or nicotine where you live, and able to form a binding contract, to use the Service. The Service is intended for adults working to reduce or quit tobacco and nicotine.

2. What Last Can is, and is not

Last Can provides educational information, planning tools, reminders, and motivational features to support your effort to cut down or quit. It is general information and behavioral support only. It is not medical advice and is not a substitute for professional diagnosis or treatment. User-directed quit and reduction schedules are planning aids, not validated medical protocols. Nicotine-pouch cessation evidence is limited. Counts and labeled milligrams do not measure absorbed nicotine. Savings estimates use reported days and current baseline/cost; changing these inputs recalculates past estimates. Missing days are unknown. Weekly pattern reviews describe explicit reports without diagnosis, causal claims, or guarantees. Always consult a clinician before making decisions about medication or your health, including products such as varenicline or nicotine replacement therapy.

3. Subscriptions and payments

Your complete chosen schedule, one primary if–then coping plan, essential daily reminder, Why Vault, basic reported progress, SOS, lapse recovery, human support, export, and deletion are free. Pro adds weekly pattern reviews when enough reports exist, multiple named coping plans, up to 12 custom daily reminder times with minute controls, and date/type/trigger history filters. Pro is available for quit-now and reduction users. Previously created plans and reminders remain readable, usable, editable, and deletable after expiration; all raw reports remain readable. Pro gates additional creation and advanced review/filter tools. Localized prices, billing periods, renewal terms, and any confirmed trial eligibility appear in the app before purchase. No trial is guaranteed.

• Payment is charged to your Apple App Store or Google Play account when you confirm purchase, or after any eligible free trial shown by the store. Cancel before the trial renewal deadline shown by the store to avoid its charge.
• Unless you cancel, the subscription renews automatically at the end of each period, and your account is charged the renewal price within 24 hours before the period ends.
• You can manage or cancel your subscription anytime in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• Refunds are handled by Apple or Google under their policies; we generally cannot issue store refunds directly.

For apps installed from the Apple App Store, your use is also subject to Apple's Licensed Application End User License Agreement. Where that EULA and these Terms conflict for the iOS app, the applicable EULA governs the license to use the app.

4. Acceptable use

You agree not to misuse the Service. In particular, you will not: copy, resell, or redistribute the Service; reverse engineer or attempt to extract source code except where the law allows; interfere with or disrupt the Service; or use it in any unlawful way.

5. Your content

Content you create in the app, such as the reasons, notes, and media in your Why Vault, is yours and stays on your device. You are responsible for the content you add. Native app-state snapshots use AES-256-GCM. Vault media and exported files are not encrypted by that codec; web QA storage is plaintext. Optional product analytics requires fresh opt-in at each launch. Use the free in-app export/deletion controls; deletion waits for completion and offers retry on failure, but cannot remove external copies or cancel a subscription. 6. Intellectual property

The Service, including its software, design, text, and graphics, is owned by Last Can and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, subject to these Terms.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that using it will result in quitting or any particular health outcome.

8. Limitation of liability

To the fullest extent permitted by law, Last Can will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim.

9. Changes to the Service and these Terms

We may update, change, or discontinue parts of the Service, and we may revise these Terms. If we make material changes, we will update the date above and post the new Terms here. Your continued use after changes take effect means you accept the updated Terms.

10. Termination

You may stop using the Service at any time by deleting the app. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will continue to apply.

11. Governing law

These Terms are governed by the laws of the United States and the state in which the operator of Last Can resides, without regard to conflict-of-law rules. Nothing here limits any non-waivable consumer protection rights you have where you live.
